Manitoba Land Surveying Corporate Permit

Ownership Requirements:	Corporations Each voting share of the corporation is legally and beneficially owned by a Manitoba land surveyor or a professional corporation Each other share in the capital stock of the corporation is both legally and beneficially owned by a person who is: a voting shareholder of the corporation a spouse, common-law partner or child, within the meaning of the Income Tax Act (Canada), of a voting shareholder of the corporation, or a corporation each share of the capital stock of which is legally and beneficially owned by a person referred to in one of the two bullet points above Each director of the corporation is a Manitoba land surveyor The president of the corporation is a Manitoba land surveyor Each person through whom the corporation will be providing professional services is a Manitoba land surveyor or an employee of the corporation, but only if the employee is acting under the supervision of a Manitoba land surveyor through whom the corporation will be providing professional services
Notes:	The name of the corporation must include one of the following: "Manitoba Land Surveyor", "Manitoba Land Surveyors", "Manitoba Land Surveying" or the initials "M.L.S.", and is approved by the registrar in accordance with the by-laws The name must be: in good taste not be self-laudatory not misrepresent or mislead the public with respect to the number of Manitoba Land Surveyors associated with the firm not misrepresent capabilities or areas of expertise of the firm be truthful and respectful in all other matters

Form:	Form-E will be supplied to the applicant upon the issuance of a certificate in Step 4.
Instructions:	The member must check with the Companies Office that the proposed name isn't confusingly similar to one already on record. The member shall apply in writing to the Registrar for a Certificate that the Association consents to the proposed name of the Corporation. The Registration Committee shall review the corporate name and shall reject the name if not in accordance with the Act, the by-laws or is deemed to not be appropriate for any other reason. The Registrar shall issue a certificate to the member if the proposed name complies with the Act and all applicable by-laws, or reject the application and notify the member in writing of the decision and the reasons for rejection. The member will proceed to register the Corporation under The Corporations Act. The Corporation will apply to the registrar for a permit and submit any required attachments and fees.
