Companies that provide insurance producer services in Oklahoma must apply for a license prior to doing
business. Depending on the lines of authority offered by the entity and the types of services offered, multiple
firm licenses may be required.
Before applying, firms should ensure that the licensed individual to be appointed agent in charge has the
necessary licenses. Firms should also gather proof of incorporation, or foreign qualification for out-of-state
firms, in anticipation of application requirements.

Insurance Requirements:
National Association of Insurance Commissioners (NAIC) Biographical Affidavits- required for officers, directors, key management and any person acquiring ten percent (10%) or more controlling interest in any TPA. Per TITLE 36 O.S. § 1450 (C) and TITLE 36 O.S. § 615.2.
NAICS Biographical Affidavits for all key employees holding a 10% or more controlling interest in the TPA
Third-Party Vendors for Background Reports
$10,000 bond payable to the People of Oklahoma
Articles of Incorporation and Bylaws or Articles of Organization and Operating Agreement
Certificate of Authority from the Oklahoma State Secretary (foreign qualification)
Proof of Third Party Licensure in Home State
List of insurers or trusts the TPA has or will have an agreement with
Notification of any Administrative Action in other states, including a copy of paid fines or fees and a statement summarizing same
Required Attachments:
Articles of Incorporation and Bylaws or Articles of Organization and Operating Agreement, Certificate of Authority from the Oklahoma State Secretary, and Proof of Third Party Licensure in Home State.
Bond Amount:
One Bond in an amount not less than Ten Thousand Dollars ($10,000) made payable to the People of Oklahoma.
TPA Surety Bond, Proof of Third Party Licensure in Home State, a list of names and addresses of the insurers and/or funds the TPA has contracted with in accordance with Title 36 O.S. §1450(E), and copy of any administrative action(s) from any state since last renewal.
List of the type and qualifications of the personnel either employed or under contract to perform the utilization review
Procedures and policies in place to ensure that a representative of the private review agent is reasonably accessible
Policies and procedures in place to ensure that all applicable State and Federal laws to protect the confidentiality of individual medical records are followed
Policies and procedures in place to verify and identity the authority of personnel performing utilization review by telephone
A copy of all materials designed to inform applicable patients and health care providers of the requirements of the utilization review plan
A list of the third party payers for which the private review agent is performing utilization review in this state. Said list may be deemed confidential by the Commissioner for the purpose of protecting competition between agents
Procedures in place for handling complaints by patients and health care providers concerning utilization review
Procedures in place to ensure that after a request for medical evaluation, treatment, or procedures has been rejected in whole or in part and in the event a copy of the report on said rejection is requested, a copy of the report of the private review agent concerning the rejection shall be mailed by the insurer, postage prepaid, to the ill or injured person, the treating healthcare provider, or to the person financially responsible for the patient’s bill within fifteen (15) days after the receipt of the request for the report
