A life and health administrator, also know as a third-party administrator ("TPA") collects money or processes claims for residents of Arizona in connection with life or health insurance coverage.  Arizona Revised Statutes ("ARS") § 20-485 provides a full definition, including the types of entities that are not considered TPAs.

A deposit in favor of the state in the amount of $5000 (the greater of $5,000 or 10% of the amount in Section C, Item 6) to be held in trust for the benefit and protection of insureds and insurers whose monies the administrator handles (ARS 20-485.10) by ONE of the following methods:

a. Surety bond: Must be issued by an insurer authorized in Arizona to offer surety bonds; may include individual bonds, schedule or blanket bonds. You cannot use an existing fidelity or liability policy to satisfy this requirement. ENCLOSE Form E-157 and an Attorney-in-Fact. OR

b. Certificate of deposit (CD): ENCLOSE one E-125-CD form, two E-150 forms, and the original of the CD. OR

c. Marketable security: ENCLOSE one Custody Agreement (Form E-003) and one Form E-125.

Agents that only conduct reviews for government coverage (Medicare or Medicaid) are not required to register.   • A copy of a national UR accreditation certificate (URAC, NCQA or AAGC) if applicable.
  • A utilization review plan that includes a summary description of review guidelines, protocols and procedures, standards and criteria to be used in evaluating inpatient hospital care, inpatient medical care, outpatient surgical care and any medical, surgical and health care services that may be covered by a health care insurer and the provisions by which patients, providers or hospitals may seek reconsideration or appeal of decisions made by the utilization review agent.
  • A list of all contracts (if any) the entity has with a health care insurer or third party administrator to conduct utilization review for fully insured commercial plans in Arizona.
  • A copy of the materials or a description of the procedure designed to inform patients and providers, as appropriate, of the requirements of the utilization review plan.
