Stricter Licensing Standards for Individuals
One of the most notable updates in LB102 is the enhanced licensing requirements for land surveyors. Under the previous regulations, there were fewer specifics surrounding the qualifications for surveyors, particularly for non-residents. Now, LB102 requires that all non-resident professional land surveyors, even if licensed in another state, pass a Nebraska-specific examination to ensure familiarity with local laws, procedures, and standards.
This ensures that out-of-state surveyors have the necessary knowledge to conduct surveys that meet Nebraska’s updated standards, particularly the Nebraska Plane Coordinate System, which governs how survey points are measured and recorded.
New Requirements for Organizational Practice
LB102 also introduces a formal process for organizations offering land surveying services. Under the new law, any organization conducting land surveys must designate a professional land surveyor to oversee all surveying work. This individual must be in “responsible charge,” meaning they are fully accountable for the quality and accuracy of the surveys conducted.
Additionally, organizations are now required to apply for a certificate of authorization from the state board. This certificate must be renewed annually, and the company must notify the board within 30 days of any changes in the designated responsible surveyor. These steps are designed to increase accountability and ensure that all land surveys are conducted under the supervision of qualified professionals.
Clear Timelines and Accountability
Another important update introduced by LB102 is the requirement that surveys be filed with the appropriate county office within 90 days of completion. While individual land surveyors have always had filing obligations, the new law enforces a strict timeline, reducing delays and ensuring timely record-keeping. This filing must include a detailed description of the methods, corners, and points used in the survey, further enhancing transparency.
